Background

When organisations are involved in legal, commercial or regulatory disputes, they often need more than technical analysis alone. They need an expert who can translate complex industry arrangements, pricing structures, operational practices and business impacts into clear, defensible evidence. NineSquared experts have been engaged to provide expert evidence on access arrangements, service fees and market differences across different jurisdictions. We have also provided expert witness advice on the business impacts of a major site relocation, including operational change, capacity, throughput and compensation-related issues. Across these matters, the common challenge was the same: decision-makers and legal advisers needed independent, well-structured analysis grounded in evidence, industry understanding and a clear expert methodology

Our Role

NineSquared was engaged to provide independent expert witness support, including review of background materials, analysis of published information, targeted confidential discussions with relevant parties and industry contacts, and preparation of formal expert opinions for use in legal proceedings. Our work drew on documentary review, market and operational analysis, and structured modelling where required to assess matters such as pricing arrangements, service provision, site capacity, throughput and the practical implications of operational change. In both engagements, the work was undertaken within the requirements of the relevant expert witness codes of conduct, with emphasis on independence, clarity of reasoning and transparent treatment of assumptions and evidence.

Importantly, our role was not limited to producing a report. We helped shape the analytical framework for the issues in dispute, identified the evidence needed to address contested questions, briefed legal advisers on emerging findings, and developed expert reports and affidavits that could be used confidently in formal processes. The resulting work supported the resolution of questions relating to pricing, access arrangements, business impacts and compensation, while demonstrating NineSquared’s ability to bring together commercial insight, regulatory understanding and disciplined evidence-based analysis in high-scrutiny environments. This reflects the broader way we support clients: helping them understand what has happened, why it matters, and how complex facts can be translated.
